General Information

Artwork: Digital art by e-mail is preferred. We support the following computer formats: Adobe Illustrator, Adobe Photoshop and Freehand. Tiff files for 1 color logos may be acceptable if sent to actual size or larger. No other file formats are accepted. Vector-based art files are strongly recommended for the best logo reproduction on your product. Please convert all text to outlines (exact type style matches are otherwise not guaranteed). Include PO# and company name on all correspondence including artwork. If necessary, artwork can be recreated in vector format from your sketch at a charge of $60.00(V) per hour. Please allow additional time for processing of your order if art services are required. Email artwork to: art@baumessexpromo.com.

Art Proof Approval: Along with order acknowledgements, we will either fax or email a copy of your artwork showing logo layout on your product in the designated imprint colors. Please check for spelling, phone numbers, size and positioning. Correct art/logo proofs must be signed and faxed back to the factory before production can begin.

Cancellations: Any correction or cancellation of an order in process must be submitted in writing. All charges incurred to date will be billed accordingly. Minimum charge is $50.00 (V).

Catalog Logo Representation: Products and logos used in this catalog are not intended to represent or endorse the product, or suggest they are available for resale. They are not. They are shown only to illustrate our ability to include messages and art on them.

Claims: Claims must be made in writing within 30 days after receipt of shipment. No shipment can be returned in part or whole without an RA # issued by the factory. Returns with no RA # will be refused.

Co-op Programs: Special quotations available by factory on co-op programs. Please submit in writing the program description along with anticipated yearly product usage.

Country of Origin: Product origin differs by product line. If this is an important factor for your order, please verify by calling customer service in advance. All items are marked with the country of origin.

Credit Terms & Payment: Credit terms must be approved by the factory. To avoid delays for new customer orders, a 50% deposit along with credit references will be required prior to processing your order. Depending on credit history, balance payment may be requested prior to order ship date. COD orders are not accepted. Once credit is approved, terms are Net 30 days. Visa, MasterCard, and American Express are accepted. Interest on past due accounts will be charged at the rate of 1.5% per month.

Direct Import Order: Quotations are available upon request. Lead times may vary depending on product line and timing. Factory will confirm FOB point along with quoted prices.

Inventory Availability: Inventory availability may change quickly and can not be guaranteed. Inventory can not be held without the receipt of a written and accepted purchase order.

Order Acknowledgements: All purchase orders are promptly acknowledged after receipt of order. You must review the acknowledgment carefully and contact us immediately with any changes or discrepancies. Correct order acknowledgements must be signed and faxed back to the factory before production can begin. All orders are subject to approval and are not binding until an order acknowledgement is issued. Phone orders are not accepted. Email orders to: order@baumessexpromo.com.

Order delays: Clients that delay in signing and returning to the factory their order acknowledgement as well as signed art proof approval (or approval of an actual product proof) can not hold the factory liable for not meeting their order in-hand date.

Pricing: All prices are subject to change without notification.

Repeat Orders: Repeat orders placed within 12 months from the last order date will incur resetup charges of $20 (V) per color. 100% color matching of product color from lot to lot can not be guaranteed.

Residential and Inside Deliveries: Orders requiring special delivery instructions such as inside delivery or being delivered to a residential address must have that information clearly written on the original order. Failure to do so will result in additional freight charges billed after the initial invoice is issued.

Samples: The client’s shipper # is required for a random sample to go out at no charge. Sample requests with a value of $20 (R) or more will be charged to your credit card. Credit card information must be supplied along with the sample request to insure samples are sent out on time.

Shipping: Shipments are made FOB CA, NJ, NY or GA as listed in each product section. If no specific method of shipment is requested on your purchase order, we will use our judgment regarding the selection of a carrier. Title and responsibility for the merchandise passes to the buyer at the FOB point. Every carton leaving the factory is quality inspected. Buyer is expected to inspect carton condition prior to signing a receipt from the carrier. If any damage is visible, a claim for damage and/or transit delays must be filed with the carrier immediately.

Split and/or Drop Shipments: There is a $10.00 (V) charge for each drop or split shipment after the first shipment. Drop or split shipments must be in full case quantities or additional charges will apply.

Special Packaging: Special packaging available. Please refer to the specific information section for each individual product line below.

Trademarks: Baum-Essex assumes that all materials submitted by our clients are in full compliance with all laws regarding copyright, trademark, service mark and patents. Clients must have full authorization to use trademarks presented to us for reproduction. We assume no liability in trademark or copyright disputes. In the case of licensed merchandise, we will require a copy of authorization along with your order.

PMS Colors: Exact color matching of imprint color is not always possible. You must specify on your order if your chosen color match is designated C or U from the pantone chart. All borosilicate labware items have further restrictions. On all of these items only basic imprint colors are available: white, black, reflex blue, red (PMS 032C), yellow (PMS 012C), orange (PMS 021C), forest green (PMS 342C) and kelly green (PMS 348C). We can only print in up to 2 colors with no color overlapping.

Preproduction & Spec Sample policy: Sample will cost $45.00 (V) plus the cost of the item, all setups and printing charges.

Production Time: 2 weeks after approval of order confirmation and paper proof.

Proposition 65: If these glassware products are to be sold or distributed in California, a warning under California law, referred to as Proposition 65, may be required. Please check with your California customer and appropriate legal counsel concerning warning requirements and methods.

Registration: When imprinting in multiple colors, a variance of +/- 1/16” may occur and must be considered acceptable.

UPS / FEDEX Shipments: All orders requiring shipment by either carrier will need repackaging into additional cartons. A $5.50 (V) per master carton charge will be incurred. To avoid this charge, we recommend orders be shipped by truck on pallets.
